  • Administrative liability:

 

A public entity can be held responsible if its activity causes damages.

​​

An administration is liable if it commits a fault or even in some cases whithout any fault commited (breach of equality of citizens before public charges, lack of maintenance of public property...).

​

A victim can sue those public entities for compensation.​

​

  • Acces to administrative documents:

 

Citizens have a right to access administrative documents that fulfill certain conditions (articles L. 300-1 and following of the relationship between the public and the administration Code (Code des relations entre le public et l'administration)).

​

Any citizen can request a public entity to be sent an administrative document. If the administration issues a refusal, the claimant can lodge an appeal to the Committee for Access to Administrative Documents (Commission d'Accès aux Documents Administratifs (CADA)).

​

  • or is signed by a public entity and has a « exorbitant clause » (clause exorbitante du Droit commun) (i.e. a clause that cannot be found in a contract signed between two individuals),

  • Saisies Administratives à Tiers Détenteur (SATD):

 

If you are liable for a tax, or an invoice to an administration (State, City or a public institution...), it can seize a third-party holding money that belongs to you (most often your bank, your pension fund, your employer...).​
